LOS is an App that is owned and operated by AMU Leasing Private Limited, a company duly incorporated under the provisions of the Companies Act, 1956 (hereinafter referred to as “we” or “us” or “our” or or “AMU” or “Platform”). We have our office at “2nd Floor, IREO Grand View Tower, sector 58, Gurgaon -122001”.
Terms and Conditions
The terms and conditions contained herein (“T&C “) contain the complete terms and conditions that apply to a client and govern the Client’s access to and use of the Service (as defined below). However, it is made clear that some of the Services may require the Client to agree to additional terms and conditions. Unless otherwise provided, those additional terms shall be deemed to be incorporated into the T&C.
- By (i) using the Platform or availing the Services provided through the Platform in any way; or (ii) browsing the Platform, the Client is deemed to have read, understood and accepted the T&C as well as the privacy policy which is available on the Platform.
- The Client acknowledges that by accessing and using the Platform and availing any of the Services, it agrees to be bound by the T&Cs. The T&C establish a relationship between AMU and the Client, whereby the Client shall act in the capacity of an originator or a Loan Company or such other capacity as may be mutually agreed between the Client and AMU.
- In the event the Client is not agreeable to the T&C, it shall not access the Platform or avail the Services.
- The T&C contained herein expressly supersede all prior agreements or arrangements between AMU and the Client.
- The Client understands that the access to the Platform and the offer of Services is conditional upon the Client’s irrevocable consent and acceptance of all the terms, conditions and obligations contained in the T&C (as may be amended from time to time). For utilizing the Services, the Client agrees to enter into or execute any document, agreement or terms and conditions which is required by AMU and agrees to be abide by such document or agreement or terms and condition while utilizing the services on the Platform.
- By accessing the Platform, the Client hereby agrees to receive communication regarding registration on the Platform or Platform Services (including but not limited to any promotional, transactional messages) through email and/or SMS and/ or any other electronic medium, third party channels (including WhatsApp) from AMU.
- By agreeing to the T&C and by availing the Services, the Client represents that it is lawfully able to enter into contracts (if an individual) or has the legal authority to enter into contracts on behalf of the body corporate/company/partnership.
- The Client acknowledges and agrees that it is solely responsible for its data uploaded to or transmitted through the Platform, as well as, the consequences of uploading or transmitting its data onto or through the Platform.
- The Client acknowledges, represents, and warrants that with respect to any data posted on or transmitted through the Platform:
- Any use by AMU of the data uploaded, transmitted, or published by it on the Platform will not constitute infringement of any third party’s rights, over such data posted or transmitted through the Platform.
- The Client agrees and acknowledges that it is solely responsible to AMU and to any Counterparty for any breach of its obligations under the T&C and for the consequences of any such breach (including any loss or damage which AMU may suffer).
- The Client acknowledges and agrees that any use of the Platform and the availing of the Services is at the sole risk of the Client.
- The Client acknowledges and agrees that it is solely responsible for its data uploaded to or transmitted through the Platform, as well as, the consequences of uploading or transmitting its data onto or through the Platform.
- The Client acknowledges, represents, and warrants that with respect to any data posted on or transmitted through the Platform:
- It has all necessary licenses, rights, consents, and permissions to upload, transmit, or publish such data and that it grants AMU, express, irrevocable license and authorization to use such data for the Services; and
- Any use by AMU of the data uploaded, transmitted, or published by it on the Platform will not constitute infringement of any third party’s rights, over such data posted or transmitted through the Platform.
- The Client agrees and acknowledges that it is solely responsible to AMU and to any Counterparty for any breach of its obligations under the T&C and for the consequences of any such breach (including any loss or damage which AMU may suffer).
- Use of platform and services
- In order to access the Platform and to obtain the benefit of the Services, the Client will have to register and create an account by providing accurate and complete information. AMU is not responsible for verifying the accuracy and completeness of any such information. The Client agrees and acknowledges that the the onus of ensuring the completeness and accuracy of such information shall, at all times, lie with the Client.
- The Client agrees that its usage of the Platform and viewing various financial products offered by AMU on the Platform, shall not in any way imply, suggest, or constitute any sponsorship, recommendation, opinion, advice (whether investment or legal) or approval of AMU in favour of or against such third parties or their products. The Client agrees that AMU is in no way responsible for the accuracy, timelines or completeness of the information and product specifications it may obtain from the Platform or the other third parties registered on the Platform.
- The Client agrees, undertakes and declares that it has made its own assessment of the Platform and has determined that it is fit for its purposes. The Client will be using the Platform at its own risk, irrespective of the capacity in which it uses the Platform and it is expressly clarified that AMU shall owe no fiduciary or other duty or obligation to the Client other than as expressly agreed in writing by AMU.
- The Client agrees and acknowledges that any transactions entered into through the Platform shall be at the sole discretion of the Client and that AMU shall not be liable for any delay, rejection or approval of any application/proposal made through the Platform, or any failure on part of the Client to settle/conclude any transactions.
- The Client agrees and acknowledges that all reports and documents provided on LOS (if any), and any information transmitted through LOS has been prepared based on the information, data and documents furnished by the Client and relevant counterparties onboarded onto the Platform. The Client hereby agrees and acknowledges that AMU does not warrant the genuineness of such information and shall not be liable for any error, deviation or omission in such reports, documents or information on account of any error, deviation or omission of whatsoever nature in the information collected from/furnished by the Client, or any other person in this regard. The Client further acknowledges that AMU has carried out any “know your customer” or credit underwriting or any other similar or related checks in relation to any counterparty registered on the Platform or any information shared by such counterparty, and all such diligences and checks required under applicable law to verify the genuineness or lack thereof in relation to the Client, or information shared by the Client shall at all times, be the sole responsibility of the Client.
- Without prejudice to the above, the Client hereby agrees, acknowledges and accepts that AMU may, for the purpose of rendering the Services, seek to obtain such necessary and requisite information and data as required by it from various authoritative sources including but not limited to statutory and regulatory filings, credit bureau records and such other sources as determined by it at its sole discretion, as required by it to effectively render the Services and the Client hereby accepts and provides consent for the same.
- The Client hereby agrees and understands that its account created for the purposes of using the Services shall be visible to all counterparties and platform users of the Platform and irrevocably consents to the same. Provided that it is clear that nothing in these T&C shall be construed in a manner as to require AMU to obtain any specific or additional consent from the Client with respect to featuring the Client’s user account on its Platform and/or displaying the same to other counterparties, clients, investors (as applicable) along with the information furnished by the Client to AMU as regards the Platform. It is understood that the information shared by the Client with AMU as reflected on the Platform shall be in accordance with applicable laws in force.
- AMU reserves the right to reject the request for creation of the account, at its sole discretion, if the data or information submitted appears to be incomplete, incorrect or fraudulent.
- On the creation of the account, AMU grants to the Client a non-exclusive, limited privilege to access and use the Platform and the Services offered on the Platform, subject to compliance with the T&C. The account created by the Client for use of the Platform shall be is non-transferable and its use is restricted to the Client creating the account.
- The Client is solely responsible for its account and any activity on it, and must keep the log-in credentials (log-in ID and password) in respect of its account secure at all times. The Client shall not sell, transfer or sub-license the log-in credentials in relation to its account on the Platform to any other person. The Client shall ensure that only its duly authorised personnel shall access and operate its account. The Client undertakes that the Client shall promptly on becoming aware of any unauthorized use of its account, notify support@amuleasingpl.com of such unauthorised use or access. It is expressly understood that AMU shall not be liable to ensure or verify that the usage of the Client’s account is by its authorised persons and that the onus of ensuring that only authorised personnel access and operate the said account shall, at all times, lies with the Client. The Client agree and acknowledge that failure to AMU regarding any such unauthorized use of its account on the Platform may attract liability on the Client for any losses/damages caused by any unauthorized use of the account.
- The availing of the Services and the use of Platform is only for purposes permitted by: (i) the T&C; and (ii) any applicable law, regulation or generally accepted practices or guidelines and the same shall not be for any other illegal or other purpose which is expressly or impliedly barred by any applicable law, statute, ordinance or regulation in force from time to time.
- General undertakings of the client
- The Client agrees to access any information, material, documents on Platform, provided by itself or any third party but accessible to the Client, or avail any Service only through the authorised access provided by AMU.
- The Client shall not use or attempt to use any unauthorised means, including but not limited to, use of any deep link, program, automatic device, algorithm or methodology, or any similar processes, or hacking to access, utilise, copy or monitor any part/feature of the Platform or its content, or avail any Services or in any way reproduce or circumvent the source code, structure or layout of the Platform, or obtain or attempt to obtain any information not openly available on the Platform.
- The Client undertakes not to attempt to gain any unauthorized access to the Platform, the server on which the Platform is hosted or any other database, server or computer connected to the Platform.
- The Client shall not misuse the Services or corrupt or try to corrupt the Platform by introducing any bugs, viruses, worms, malwares, spyware or any similar program which is malicious or harmful.
- The Client undertakes to ensure that any material/information/data uploaded by it on the Platform is strictly of nature and context as required by the Platform for the relevant Service, and is not in violation of any applicable law.
- The Client further undertakes not to:
- Impersonate any person or entity, or misrepresent its affiliation with a person or entity;
- Publish, post, upload or distribute files that contain bugs, viruses, worms, malwares, spyware or any similar program, or corrupted files that may disrupt the operation of the Platform or a Counterparty’s computer;
- Engage in any activity that disrupts access to the Platform or the Services;
- Disrupt or interfere with the security of, or otherwise cause harm to, the Platform, accounts, passwords, servers or networks connected to or accessible through the Platform;
- Cause any interference or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform;
- Upload or distribute files that contain such material which is infringing the copyrights, trademarks, confidentiality, privacy or any other proprietary information protected by law, unless the Client has the rights or the necessary consents thereto;
- Use the Platform or Services for any purpose that is fraudulent, unlawful or prohibited by the T&C and by applicable law, or to solicit the performance of any illegal activity or other activity which infringes the rights of AMU or any Counterparties;
- Upload or distribute any material or information that is, or contains tags or keywords which are, illegal, inappropriate, profane, obscene, offensive, abusive, harassing, misleading, indecent, defamatory, disparaging, or menacing, or is otherwise injurious to AMU or any Counterparty, or objectionable in any manner whatsoever;
- Download any file posted by the Counter party that the Client should know, or reasonably should know, cannot be legally distributed in such manner;
- Violate the T&C or any applicable laws or regulations for the time being in force;
- Decompose, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Platform.
- The Client acknowledges and agrees that all information, data or details in any form with respect to the Platform, its designs, structure and arrangement, visual interfaces, specifications, documentation, components, source code, object code, images, icons, audio-visual components and objects, schematics, drawings, protocols, processes, and other visual depictions, in whole or in part in addition to all documents, data, papers, statements, any business/customer information, trade secrets and process of AMU relating to its business practices or in connection with the provision of services by AMU, trade and business of AMU, or otherwise, any information including names, assets, details, documents, transaction records, potential transactions, negotiations, pending negotiations, data, applications, software, systems, papers, statements, business information, marketing and financial information, databases, manuals, records and reports, articles, systems, material, sources of material, and any other data pertaining to Counterparties and AMU, available to it through Platform (“Confidential Information”) is of a sensitive and confidential nature.
- The Client undertakes to keep all Confidential Information confidential and shall ensure that none any of its employees, agents, representatives do anything to breach the confidentiality. The Client undertakes to use all Confidential Information with such care and discretion, but not less than reasonable care, to avoid disclosure, publication or dissemination of Confidential Information as it uses with its own similar information that it does not wish to disclose, publish or disseminate.
- The Client may disclose Confidential Information only to:
- Its employees, representatives, agents or contractors on a ‘need to know’ basis and only for the purposes of performance of its obligations under the transaction/Services;
- The extent required by any regulatory authority or governmental authority under applicable law; and
- Any other party with the Client’s prior written consent.
- To take all necessary action to protect the Confidential Information against misuse, sale, loss, destruction, deletion and/or alteration;
- Use the Confidential Information only in connection with the Services/transaction for which the Confidential Information is obtained; and
- Not to misuse or permit misuse directly or indirectly, commercially exploit the Confidential Information of AMU or any other Counterparty available to it through the Platform for economic or other benefit or in a manner prejudicial to AMU.
- The storage, usage and transmission of all information obtained by it through the Platform, shall at all times be in accordance with the Information Technology Act, 2000 read with Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and all other applicable law.
- In the event AMU obtains any Personal Data or Confidential Information pursuant to any transaction/Services, it shall only undertake the processing of Personal Data/Confidential Information reasonably required in connection with the performance of its obligations under the transaction/Services. the event any such Personal Data and/or Confidential Information is required to be used by AMU for any purpose not expressly set out herein post termination/consummation of the transactions/Services contemplated hereunder, the same shall take place pursuant to obtaining prior consent from the Client in this regard.
- AMU shall at all times have appropriate technical and organisational measures in place to:
- Prevent unauthorized or unlawful processing of any Personal Data/Confidential Information
- Protect any Personal Data/Confidential Information against accidental loss, destruction or damage;
- Ensure the reliability of its employees/contractor having access to the Personal Data/Confidential Information;
- AMU shall comply with all applicable law, including without limitation the Data Protection Laws to safeguard the Personal Data/Confidential Information. For the purposes of this clause, Personal Data shall mean the information related to the underlying borrowers to whom credit facilities may be extended by the Client (if the Client is acting as an investor) or sourced by the Client (if the Client is acting as the originator) including their personally identifiable information and sensitive personal information (as envisaged under the Information Technology Act, 2008, and the rules made thereunder, each as amended from time to time).
- AMU, its, employees, agents, and associates, will not be liable with respect to any subject matter relating to the T&C under any contract or torts, or on account of negligence, strict liability or other legal or equitable rights for: (i) any special or consequential damages; (ii) for interruption of use; (iii) loss or corruption of data.
- AMU shall not be liable or responsible for:
- Any faulty operation of system during accessing of Platform or during the transmission/transfer of any data/information;
- Any damage that occurs due to any information provided by the Client but not being received by AMU or any Counterparty or not being received promptly or appropriately, as a consequence of technical faults with the Platform (whether or not in AMU’s control);
- Any Confidential Information of the Client being used in any manner contrary to Clauses 5(c) and 5(d) by any Counterparty;
- Any loss or damage caused due any bugs, viruses, worms, malwares, spyware or any similar program that may infect the Client’s computer, software, data or any other property caused by accessing or using the Platform or availing any Services, or from any emails, communication or attachment received from AMU /Platform;
- Any failure to perform, or delay in performance of, any of obligations or Services by AMU or any Counterparty due events outside AMU’s reasonable control;
- Any breach of the T&C by any Counter party;
- AMU is not responsible for any indirect losses including, without limitation, loss of income, business, profits, data or any injury to reputation, howsoever arising.
- AMU is not responsible for any liability for any loss, costs or damage arising out of or in connection with the use of the Platform or the inability to use it or for any delay or failure in the performance of the Services on account of the Counterparty or due to any Force Majeure Event or any other circumstances beyond the control of AMU.
- The Client acknowledges that AMU aims to facilitate seamless data and transaction processing and that AMU is not responsible for any failure of the Platform to store, transfer or delete data or for the corruption or loss of any data, information or content contained therein.
- The T&C are binding on the Client, its successors and permitted assigns. It may not transfer, assign, charge or otherwise dispose of any of its rights, benefits, liabilities or obligations, under the T&C without the prior written consent of the AMU.
- However, AMU may transfer, assign, sub-contract or otherwise dispose of any of its rights, benefits, liabilities or obligations under the T&C at any time or ay involve or appoint any third party to satisfy its obligations, without any necessity to notify the Client.
- All facilities used to store data and process the transaction will adhere to reasonable security standards, which will be at par with AMU’s security standards for processing and storing its own information of a similar nature. AMU has implemented industry standard systems and procedures to ensure the security and confidentiality of a transaction and related data, protect the Client against anticipated threats or breaches to the security or integrity of a transaction and related data, and protect the Client against unauthorized access to its data.
- The Client further acknowledges and agrees that it has granted AMU the permission as well as the non-exclusive right to store and transfer its data, as part of the Services.
- AMU does not claim any ownership, intellectual property rights or other rights whatsoever outside the scope of what is necessary to provide the Services.
- AMU reserves the right to perform statistical analysis of the activity on Platform in order to measure interests in the various sections of the Platform for the purpose of product and Service development. Any non-personal information such as internet domain, host names, IP addresses, clickstream patterns, and the dates and times on which Platform is accessed may be recorded for the purpose of analysis. The analytical data collected is for internal use only.
- The Platform and the arrangement and processes thereof, including, but not limited to, all text, graphics, user interfaces, visual interfaces, and the computer code, source code, object code and is owned by AMU, and the design, structure, and arrangement of thereof is protected by copyright, patent and trademark laws, and all other applicable intellectual property laws and the Client shall not use the aforesaid without the prior written consent of AMU
- The trademarks, logos and marks displayed on the Platform are the property of AMU, or the property of the Client(s) or of the Counterparty(ies), as the case may be. The Client shall not use any trademarks, logos and marks not belonging to it, without the prior consent of AMU or the Counterparty, as the case may be.
- In the event the Client infringes or attempts to infringe the copyrights or other intellectual property rights of AMU, AMU may, in its sole discretion, deny the Client access to and use of the Platform.
- Communication with counter parties
- AMU does not control, and is not responsible for any information, data, documents etc. appearing on the Platform or for any communication between the Client and the Counterparties inter se, including, without limitation, e-mails sent.
- The Client acknowledges that any communication received from Platform, including, without limitation, emails are automated communications and AMU is not responsible the inaccuracy etc. of the content thereof.
- AMU does not endorse, guarantee, or assume any responsibility for any Services offered to the Client, and AMU will not be a party to, or in any way be responsible or liable for any transaction between the Client and the Counterparties on or through the Platform.
- The Client shall be responsible for identifying and paying all taxes, duties, cess and other fees and charges (and any penalties, interest, and other additions thereto) that are payable by the Client with respect to the transactions through the Platform.
- AMU will not be liable to pay, any taxes which are payable by the Client to any governmental authority for any such transaction.
- The Client acknowledges and agrees that AMU has the right to revise, modify, amend or discontinue any of the T&C from time to time including without limitation to reflect, inter alia, changes in market conditions, technology, requirements, laws etc. and AMU shall not be obligated to obtain any approval/consent of the Client on the revised T&C.
- The Client is deemed to be aware of the latest T&C and the use of Platform and the availing of the Services is subject to the most current version of the T&C available on the Platform at the time of such use. The use of Platform and Services subsequent to any modification in the T&C will constitute the Client’s acceptance of the modification.
- Temporary suspension & termination
- AMU does not guarantee uninterrupted access to the Platform. The access to Platform or the Services may be disrupted:
- On the occurrence of Force Majeure Event;
- For the purposes of repair, maintenance, upgrading or for other similar activities, AMU undertakes to take all reasonable measures to minimize any such periods during which the Platform and the Services are unavailable and shall put best effort in resuming the Services and the Platform.

- AMU shall not be responsible or liable for any losses or damages suffered due to any of the events specified in sub-Clause (a) above due to the suspension of Services or due to the inability to cure such events.
- In the event of a system failure due to any unforeseeable circumstances or disruption, the access to Platform and Services may be temporarily suspended and no information may be accepted during such suspension.
- AMU has the right to temporarily or permanently disable the Client’s account when, in AMU’s opinion, without any cause or notice. On such breach, AMU may also block access to the Client’s account and/or procure that any outstanding transactions are cancelled/suspended immediately.
- AMU reserves the right to restrict or suspend access to the Platform or terminate the Platform completely, at its sole discretion.
- All provisions of the T&C, which by their nature should survive termination, shall survive termination, including, without limitation, ownership, warranty, limitations of liability, confidentiality, disclaimers, indemnity.
- The Platform is provided on “as is” and “as available” basis. AMU hereby disclaims all warranties of any kind, express or implied, including without limitation, the warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, availability, accuracy, completeness, security or reliability of the Services and/or any data uploaded, used or transmitted on or through the Platform. The Client uses the data and/or the Services through the Platform at its own discretion and risk and AMU is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such data and the Client assumes all liability for its use.
- The information contained in the Platform is provided on “as is” and “as available” basis. The accuracy of the information is sole responsibility of the Client providing the same and the Platform and AMU are not in any manner whatsoever liable for the accuracy of the information contained in the Platform. The Client specifically acknowledges and agrees that the application and impact of laws in relation to the information provided on the Platform can vary widely based on the specific facts involved. Given the changing nature of laws, rules and regulations, and the inherent hazards of electronic communication, there may be delays, omissions or inaccuracies in information contained in this Platform. Accordingly, the Client acknowledges and accepts that the information in this Platform is provided with the understanding that AMU is not herein engaged in rendering legal, accounting, tax, credit/investment or other professional advice and services. As such, it should not be used as a substitute for consultation with professional accounting, tax, legal, credit/investment or other competent advisers and the Client utilising the Platform is solely responsible for all investment decisions, made in relation to any information accessed through the Platform without any reference to, or recourse against the Platform and/or AMU.
- AMU is not obligated to be involved in or facilitate the resolution of any dispute between the Client and the Counterparties on the Platform, the Client hereby releases AMU, its employees, agents, and associates from any claims, demands and damages, arising out of or in any way related to such disputes. Without prejudice to the above, the Client hereby waives any legal or equitable rights or remedies that it may possess against AMU in relation to the dispute.
- The Client hereby agrees to indemnify and hold harmless AMU (including its directors, employees, representatives and agents) from time to time, against any and all losses, liabilities, obligations, damages, judgments, costs, expenses (including, without limitation, advisors’ fees), claims, fines, penalties, proceedings, actions or demands, of any kind or nature incurred by AMU /caused to AMU on account of Client’s use of the Platform or the Services, including but not limited to the violation of the T&C.
- Governing law and Jurisdiction
- The T&C are governed and construed in accordance with the laws of India and the Client hereby submits themselves to the exclusive jurisdiction of courts and tribunals at New Delhi, India. The Client irrevocably waives any objection it may have now or in the future to the choice of courts and tribunal of New Delhi, India as an inconvenient forum.
- Every provision contained in the T&C shall be severable and distinct from every other provision and if at any time any one or more of such provisions is or becomes invalid illegal or unenforceable, the validity, legality and enforceability of the remaining provisions hereof shall not be in any way affected or impaired thereby.
- Neither the failure to exercise nor any delay in exercising any right, power, privilege or remedy under the T&C shall in any way impair or affect the exercise thereof or operate as a waiver thereof in whole or in part.
- No single or partial exercise of any right, power, or privilege under the T&C shall prevent any further or other exercise thereof or the exercise of any other right, power, privilege or remedy.

Unless repugnant to the context, the terms used in the T&C have the following meaning:
“AMU” means AMU Leasing Private Limited (including its successors and assigns)
”Client” means
- In case of an individual, any person who has an account on the Platform; or
- In case of persons other than individuals,some text
- An entity who holds an account on the Platform, and who may access the Platform through its representatives or authorised officials; or
- An entity on whose behalf any authorised representative or person may hold an account on and access the Platform.
- ”Counter party” means any person with which the Client:
- Enters into any arrangement/contract/agreement with, pursuant to or by way of the Services or the Platform; and/or
- May potentially enters into any arrangement/contract/agreement with, by availing the Services on the Platform.
- ”Force Majeure Event” includes any act, event, non-happening, omission or accident beyond the reasonable control of AMU and includes, without limitation, the following events:
- Strikes, lock-outs or other industrial action;
- Riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
- Impossibility of the use of public or private telecommunications networks or internet services; and
- The acts, decrees, legislation, regulations or restrictions of any government, as may be applicable.
"Personal Data” shall have the same meaning as ascribed to the term “Sensitive Personal Data or Information” under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (as amended from time to time).
”Services” means the product or services offered by AMU through the Platform, including but not limited to facilitation interaction between the Client and Counter parties to enable them to enter into transactions, including (without limitation) for securitisation, direct assignments, or any other product or services offered.

Terms and Conditions For Online Payments
The Terms and Conditions contained herein shall apply to any person (“User”) using the services of AMU Leasing Private Limited. (AMU Leasing) for making online payments through an online payment gateway service (“Service”) offered by Phone pay ,through AMU Leasing website i.e. amuleasingpl.com
Each User is therefore deemed to have read and accepted these Terms and Conditions.
A.Privacy Policy
AMU Leasing respects and protects the privacy of the individuals that access the information and use the services provided through them. Individually identifiable information about the User is not wilfully disclosed to any third party without first receiving the User's permission,as covered in this Privacy Policy.
This Privacy Policy describes AMU Leasing's treatment of personally identifiable information that AMU Leasing collects when the User is on AMU Leasing's website. AMU Leasing does not collect any unique information about the User (such as the User's name, email address,age, gender, etc.) except when the User specifically and knowingly provides such information on the Website. Like any business interested in offering the highest quality of service to clients, AMU Leasing may, from time to time, send email and other communication to the User to tell them about the various services, features, functionality, and content offered by AMU Leasing's website or seek voluntary information from you.
Please be aware, however, that AMU Leasing will release specific personal information about the User if required to do so in the following circumstances:

B. General Terms and Conditions for Online-Payments
- Once a User has accepted these Terms and Conditions, he/she may register andavail the Services. A User may either register on AMU Leasing's website or by any other manner as may be specified by AMU Leasing from time to time.
- AMU Leasing's rights, obligations, undertakings shall be subject to the laws in force in India, as well as any directives/procedures of the Government of India, and nothing contained in these Terms and Conditions shall be in derogation of AMU Leasing's right to comply with any law enforcement agencies request or requirements relating to any User's use of the website or information provided to or gathered by AMU Leasing with respect to such use. Each User accepts and agrees that the provision of details of his/her use of the Website to regulators or police or to any other third party in order to resolve disputes or complaints which relate to the Website shall be at the absolute discretion of AMU Leasing.
- If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms and Conditions shall continue in effect.
- These Terms and Conditions constitute the entire agreement between the User and AMU Leasing.These Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the User and AMU Leasing. A printed version of these Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
- The entries in the books of AMU Leasing and/or the Payment Service Providers kept in the ordinary course of business of AMU Leasing and/or the Payment Service Providers with regard to transactions covered under these Terms and Conditions and matters there in appearing shall be binding on the User and shall be conclusive proof of the genuineness and accuracy of the transaction.
- Refund for Charge Back Transaction: In the event there is any claim for/ of charge back by the User for any reason whatsoever, such User shall immediately approach AMU Leasing with his/her claim details and claim a refund from AMU Leasing alone. Such refund (if any) shall be affected only by AMU Leasing via a payment gateway or by means of a demand draft or such other means as AMU Leasing deems appropriate. No claims for refund/ charge back shall be made by any User to the Payment Service Provider(s), and in the event such claim is made, it shall not be entertained.
- In these Terms and Conditions, the term “Charge Back” shall mean approved and settled credit card or net banking purchase transactions, which are at any time refused, debited, or charged back to the merchant's account (and shall also include similar debits to Payment Service Provider's accounts if any) by the acquiring bank orcredit card company for any reason whatsoever, together with the bank fees,penalties, and other charges incidental thereto.
- Refund for fraudulent/duplicate transactions: The User shall directly contact AMU Leasing for any fraudulent transactions on account of the misuse of Card/Bank details by a fraudulent individual/party, and such issues shall be suitably addressed by AMU Leasing alone in line with their policies and rules
- Server Slow Down/Session Timeout: In case the Website or Payment Service Provider’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or notand accordingly resort to one of the following options:
- In case the Bank Account appears to be debited, ensure that he/ she does not make the payment twice and immediately thereafter contact AMU Leasing via e-mail or anyother mode of contact as provided by AMU Leasing to confirm payment.
- In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.
However, the User agrees that under no circumstances shall the Payment Gateway Service Provider be held responsible for such fraudulent/duplicate transactions, and hence no claims should be raised to the Payment Gateway Service Provider. No communication received by the Payment Service Provider(s) in this regard shall be entertained by the Payment Service Provider(s).
C.Limitation of Liability
- AMU Leasing has made this Service available to the User as a matter of convenience. AMU Leasing expressly disclaims any claim or liability arising out of the provision of this Service. The User agrees and acknowledges that he/she shall besolely responsible for his/her conduct and that AMU Leasing reserves the right to terminate the rights to use of the Service immediately without giving any prior notice thereof.
- AMU Leasing and/or the Payment Service Providers shall not be liable for any inaccuracy, error, or delay in, or omission of (a) any data, information, or message, or (b) the transmission or delivery of any such data, information, or message; or (c) any loss or damage arising from or occasioned by any such inaccuracy, error, delay, or omission, non-performance or interruption in any such data, information, or message.Under no circumstances shall AMU Leasing and/or the Payment Service Providers,its employees, directors, and its third-party agents involved in processing, delivering,or managing the Services be liable for any direct, indirect, incidental, special, or consequential damages or any damages whatsoever, including punitive or exemplary, arising out of or in any way connected with the provision of or any inadequacy or deficiency in the provision of the Services or resulting from unauthorized access or alteration of transmissions of data or arising from suspension or termination of the Services.
- AMU Leasing and the Payment Service Provider(s) assume no liability whatsoever for any monetary or other damage suffered by the User on account of:
- The delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of the Payment Gateway or Services inconnection there to; and/or
- Any interruption or errors in the operation of the Payment Gateway.
- The User shall indemnify and hold harmless the Payment Service Provider(s) and AMU Leasing and their respective officers, directors, agents, and employees, from any claim or demand, or actions arising out of or in connection with the utilization ofthe Services.
- The User agrees that AMU Leasing or any of its employees will not be held liable by the User for any loss or damages arising from your use of, or reliance upon the information contained on the Website, or any failure to comply with these Terms and Conditions where such failure is due to circumstances beyond AMU Leasing’s reasonable control.
D. Miscellaneous Conditions:
- Any waiver of any rights available to AMU Leasing under these Terms and Conditions shall not mean that those rights are automatically waived.
- The User agrees, understands, and confirms that his/her personal data, including without limitation details relating to debit card/credit card transmitted over the Internet, may be susceptible to misuse, hacking, theft, and/or fraud, and that AMU Leasing or the Payment Service Provider(s) have no control over such matters.
- Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by the User, AMU Leasing does not represent or guarantee that the use of the Services provided by/through it will not result in theft and/or unauthorized use of data over the Internet.
- AMU Leasing, the Payment Service Provider(s), and its affiliates and associates shall not be liable, at any time, for any failure of performance, error, omission, interruption,deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction, or unauthorized access to, alteration of, or use of information contained on the Website.
- The User may be required to create his/her own User ID and Password in order to register and/or use the Services provided by AMU Leasing on the Website. By accepting these Terms and Conditions, the User agrees that his/her User ID and Password are very important pieces of information, and it shall be the User’s own responsibility to keep them secure and confidential. In furtherance hereof, the User agrees to:
- Choose a new password, whenever required for security reasons.
- Keep his/ her User ID & Password strictly confidential.
- Be responsible for any transactions made by User under such User ID and Password.
- The User is hereby informed that AMU Leasing will never ask the User for the User’s password in an unsolicited phone call or in an unsolicited email. The User is hereby required to sign out of his/her AMU Leasing account on the Website and close the web browser window when the transaction(s) have been completed.This is to ensure that other access the User’s personal information and correspondence when the User happens to share a computer with someone else or is using a computer in a public place like alibrary or Internet café.
E.Debit/Credit Card, Bank Account Details
- The User agrees that the debit/credit card details provided by him/her for use of the aforesaid Service(s) must be correct and accurate, and that the User shall not use a debit/credit card that is not lawfully owned by him/her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid debit/credit card details.
- The User may pay his/her fees to AMU Leasing by using a debit/credit card or through an online banking account. The User warrants, agrees, and confirms that when he/she initiates a payment transaction and/or issues an online payment instruction and provides his/her card/bank details:
- The User is fully and lawfully entitled to use such credit/debit card, bank account for such transactions.
- The User is responsible to ensure that the card/bank account details provided by him/her are accurate.
- The User is authorizing debit of the nominated card/bank account for the payment of course fees selected by such User along with the applicable Fees.
- The User is responsible to ensure sufficient credit is available on the nominated card/bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.
F. Personal Information
- The User agrees that, to the extent required or permitted by law, AMU Leasing and/or the Payment Service Provider(s) may also collect, use, and disclose personal information in connection with security-related or law enforcement investigations or in the course of cooperating with authorities or complying with legal requirements.
- The User agrees that any communication sent by the User vide e-mail, shall imply release of information therein/ therewith to AMU Leasing. The User agrees to be contacted via e-mail on such mails initiated by him/ her.
- In addition to the information already in the possession of AMU Leasing and/or the Payment Service Provider(s), AMU Leasing may have collected similar information from the User in the past. By entering the Website, the User consents to the terms of AMU Leasing information privacy policy and to AMU Leasing's continued use of previously collected information. By submitting the User’s personal information to AMU Leasing, the User will be treated as having given his/her permission for the processing of the User’s personal data as set out herein.
- The User acknowledges and agrees that his/her information will be managed in accordance with the laws for the time in force.
G. Payment Gateway Disclaimer
- The Service is provided in order to facilitate access to view and pay online. AMU Leasing or the Payment Service Provider(s) do not make any representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified in the Website for this purpose. By accepting/ agreeing to these Terms and Conditions, the User expressly agrees that his/ her use of the aforesaid online payment Service is entirely at own risk and responsibility of the User.
